Level 1 vs Level 2 Background Check in Florida

A Level 1 background check in Florida is a name-based search of Florida criminal history records only. It does not use fingerprints and does not search national FBI records. Level 1 checks are less thorough than Level 2 checks.

Level 1 checks are typically used for employment in lower-risk positions, such as non-direct-care positions in certain regulated facilities.

A Level 2 background check in Florida is a fingerprint-based search of both Florida (FDLE) and national (FBI) criminal history records. It is more comprehensive and accurate than a name-based Level 1 check.

Level 2 checks are required under Florida Statute 435.04 for employees in positions of trust or responsibility, particularly those working with children, elderly, or vulnerable adults in state-regulated settings.

Identity: Level 1 uses name and date of birth. Level 2 uses fingerprints — which cannot be falsified.

Scope: Level 1 searches only Florida records. Level 2 searches Florida and FBI national records.

Cost: Level 1 is typically less expensive. Level 2 costs $80–$105 depending on the agency.

Accuracy: Fingerprint-based Level 2 checks are significantly more accurate and harder to game with name variations or false identity.

Requirement: Most state-regulated direct-care positions require Level 2.

Level 2 background checks are required by Florida law for: AHCA-regulated healthcare workers, DOE-licensed teachers and school staff, DCF-regulated childcare workers and foster parents, APD-certified disability service workers, DBPR-licensed professionals, DOEA elder care providers, and many other regulated positions.
